County Jail. A lower court ruled to exclude blood test results in the Fierro case at the request of her attorneys -- a decision influenced by the ruling from the nation's high court.
• In a statement before the hearing, Attorney General Marty Jackley said that in the past, the Supreme Court has upheld the warrantless withdrawal of blood from people arrested for DUIs.
• Parsons says there's a difference between breath tests and more invasive blood tests. He also said South Dakota's justices don't have to rule that the whole law is unconstitutional.
• Chief Justice David Gilbertson said many people are hoping for a clear line when the justices make their ruling at a later date.
• But Parsons said there is no clear line and each case has to be considered on its own.
• "I think the court can leave the statute intact," Parsons said, as long as people have a right to refuse the test.

Sioux Falls residents to vote on school start

• SIOUX FALLS, S.D. (AP) -- A parents' group in favor of changing the starting date of Sioux Falls public schools has submitted enough valid petition signatures to force a public vote.
• School District Business Manager Todd Vik says the vote will be during the school board election next spring.
• The board has scheduled the start of school in each of the next four years for mid-August, before Labor Day. The petition calls for starting school in mid-September, after the holiday.

Tea school approved, after rejections by voters

• TEA, S.D. (AP) -- The Tea Area School Board has approved a plan to build a $5.2 million elementary school in nearby west Sioux Falls.
• The decision Tuesday night goes against the will of voters who have defeated three school bond measures in less than a year.
• "As a community, we don't get a say?" resident LeRoy Robinson said.
• The school board plans to borrow money against incoming tax revenue -- a technique that means it will not have to bring the latest proposal to voters, according to the Argus Leader newspaper (http://argusne.ws/1tmIn9q ).
