Judge clears hurdle for new Sioux Falls Walmart

• SIOUX FALLS, S.D. (AP) -- A South Dakota circuit court judge ruled that Sioux Falls officials didn't do anything wrong when they annexed land for the construction of a planned Walmart supercenter.
• A group of residents who live near the proposed site sued, arguing that April's land annexation was illegal because the city didn't first get Lincoln County's approval.
• Judge Stuart Tiede ruled Thursday that the city didn't need to get the county's permission.
• Wal-Mart Stores Inc. issued a statement saying it was pleased with the ruling. It said it has received positive comments about the planned store from city residents, including some who live near the site, KDLT-TV reported.
• The City Council is scheduled to vote Tuesday on rezoning the annexed land for the new store.
• Save Our Neighborhood spokeswoman Dana Palmer said the group hasn't decided whether to appeal the ruling. Regardless, the group will continue to oppose the store, she told the Argus Leader.
• "We didn't put all our eggs in one basket. We have other avenues to consider," she said. "That wasn't even our biggest basket."
• The group has hired a consultant to review Walmart's traffic analysis of the proposed site. The group also has gathered enough signatures to put proposed changes to the city's zoning ordinances to a public vote next year. Opponents say the changes will ease requirements for developers and give the public less of a say in what can be built.
