Opponents of $16M Fort Pierre project go to court

• FORT PIERRE, S.D. (AP) -- Opponents of a proposed $16 million development on the Missouri River in Fort Pierre are asking a judge to add more issues to a public vote on the project.
• The City Council earlier this month accepted some referral petitions and scheduled a July 9 election on a boat storage area approved for the proposed Riverwalk Landing project. But council members twice rejected petitions on zoning changes and a deferred development fee for the project, saying those council actions were administrative and therefore not subject to a public vote.
• Opponents disagree and are asking Judge John Brown to side with them. A hearing is scheduled July 3.
• The Riverwalk Landing project would include a marina, restaurant and retail space. Supporters believe it will help the city by creating jobs, generating property taxes and sales taxes and enhancing the area's quality of life.
• Opponents believe the city is giving the project preferential treatment. The effort to bring council actions to a public vote is being spearheaded by Diane London, who owns a business in the vicinity of the proposed project. Her attorney, McLean Thompson Kerver, said her client wants the judge to require the Fort Pierre City Council to honor all of the submitted petitions and stipulate that all issues be voted on in the same election, either on July 9 or at a later date.
• Mayor Sam Tidball told KCCR radio that city officials will be reviewing the court summons with their attorneys.
• A public forum on the project is scheduled for July 2. It will give people a chance to learn about the issue before the July 9 election, said Dave Bonde, executive director of the Fort Pierre Development Corp.
• "There's so much information out there, good, bad and indifferent, on either side," he told the Capital Journal.
