• A phone message left with the Little Rock, Ark.-based federal public defender representing Moeller in the execution method case was not immediately returned.
• In that case, Moeller contends the execution method violates the constitutional ban on cruel and unusual punishment, partly because drugs obtained from foreign sources not approved by federal agencies could be flawed and cause pain during the execution.
• In an order issued Thursday, federal Judge Lawrence Piersol said state officials now contend that Moeller will be executed using the one-drug pentobarbital protocol, so he will limit the court's focus on discovery to that drug.
• Jackley declined to discuss what procedures were being considered for Moeller's

execution.
• "I would say that the state in its inventory has sodium thiopental as well as pentobarbital," he said.
• Piersol said Moeller is seeking information on the source of the pentobarbital, how and when it was acquired, its location and storage and the manufacturer's instructions for the drug.
• Moeller was convicted and sentenced to die in 1997. The state Supreme Court affirmed the sentence, and Moeller has lost appeals on both the state and federal levels.
• Authorities said he kidnapped the O'Connell girl from a convenience store, drove her to a secluded area, then raped and killed her. Her body was found the next day. She had been stabbed and her throat was slashed.
• Moeller initially was convicted in 1992, but the state Supreme Court overturned it, ruling that improper evidence was used at trial.

Pine Ridge man indicted in fatal beating

• PINE RIDGE, S.D. (AP) -- A 21-year-old Pine Ridge man has been indicted on a first-degree murder charge related to the fatal baseball bat beating of a man on the reservation.
• Kyle C. Yankton pleaded not guilty Friday to the murder charge and a count of burglary.
• An FBI special agent says in a probable cause affidavit that Yankton went to his ex-girlfriend's house on June 30 looking to speak to the woman and ask if her current boyfriend, Pablo Galindo, was there.
