AUGUST 14, 2018 – GENERAL MEETING

Meeting called to order by Commission Chair Fjeldheim at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD.  Present were Commissioners Hansen, Sutton, Kippley and Fischbach.  Commissioner Hansen led the Pledge of Allegiance.

HR REPORT: Moved by Hansen, seconded by Fischbach to approve the following Commission Assistant/HR Office Report, which includes the following personnel changes:

Acknowledge Delta Dental 2019 increase of 2.7%.

Approve hiring Bailey Long and Bryan Gordon as part-time JDC Correctional Officers, effective August 20, 2018 @ $13.69 per hour.

Approve hiring the following Fair Security Employees, effective August 13, 2018: Brad Jung, Cole Kissner, Nicole Foote, Tanner Jondahl, Brad Ziegler, Ryan Rucktaeschel, Mike Wiese, Nick Cochrane, Jeff Carlson, Brent Koens, Robbie Miller, Pete Eng, Anne Weig @ $25.00 per hour; part-time Sheriff Department employees (including nurse) @ $20.00; Brian Bahr @ $31.04 per hour; regular full-time Sheriff Department employees regular pay and over-time if applicable.

AUDITORS REPORT OF ACCOUNT:   Moved by Sutton, seconded by Fischbach to approve the July 2018 Auditor’s Report of Account with the County Treasurer in total amount of $13,728,076.20 (total amount of actual cash @ $4,189.26, Cash items (bad checks) @ $810.74, US Bank @ $25,737.49, Dacotah Bank @ $6,405,202.90, Petty Cash/Change Funds @ $2,600.00, Fund Investments @ $7,289,535.81).  All members present voting aye.  Motion carried.

CLAIM ASSIGNMENT:  Moved by Kippley, seconded by Sutton to approve and authorize the Chair sign documentation to assign claim against an individual to Credit Collections Bureau for purpose of collecting a lien.  All members present voting aye.  Motion carried.

OHE DECISION: The Brown County Commission acknowledged receipt of Decision EQ 18-14 from the OHE (State of SD Office of Hearing Examiners), whereby it is the order of the Hearing Examiner that the decision of the Brown County Board of Equalization be affirmed.

LOTTERY PERMIT: Moved by Sutton, seconded by Kippley to approve application, submitted by the District 4 SD American Legion for lottery to be held at the Stratford Legion on September 23, 2018.  All members present voting aye.  Motion carried.

SPECIAL MALT BEVERAGE LICENSE HEARING: Moved by Fischbach, seconded by Kippley to authorize advertising a public hearing to be held in the Commissioners Chambers, Courthouse Annex, Brown County, SD on September 11, 2018 at 8:50 a.m. to consider the following application for Special Malt Beverage License, submitted by SPURS Therapeutic Riding Center, 1006 130th Street, Aberdeen, SD – (N ½ of Lot 1, Spurs 2nd Addition in the NW ¼ of Sec 6-T123N-R63W of the 5th P.M., Brown County, SD).  All members present voting aye.  Motion carried.

SPECIAL MALT BEVERAGE LICENSES/SPECIAL WINE LICENSE:  Moved by Hansen, seconded by Sutton to approve and authorize the Chair sign the following Special Malt Beverage License and Special Wine License Application: NESD Celtic Faire and Games – Brown County Fairgrounds (Machinery Hill) SW ¼ of Sec 1-T123N-R64W, effective September 14 and 15, 2018.  All members present voting aye.  Motion carried.

FAIR CONTRACTS: Moved by Fischbach, seconded by Sutton to approve and authorize the Chair sign the following contracts for the 2018 Brown County Fair: Amanda Taylor @ $250.00 (van driver); Ashley Farrand @ $40.00 (judge).  All members present voting aye.  Motion carried. 

INTERPRETER AGREEMENT: Moved by Hansen, seconded by Sutton to approve and authorize the Chair sign agreement with Multi-Cultural Center of Sioux Falls (MCC) to provide interpreting and translation services to the County.  All members present voting aye.  Motion carried.

LANDFILL FALL RESIDENTIAL CLEANUP: Moved by Hansen, seconded by Kippley to approve waiving fees on all material types from Residential Users Only, during the Fall Residential Cleanup at the Brown County Landfill (no other drop sites available), to be held from August 24 thru September 8, 2018 (open Labor Day).  Tire disposal is limited to 4 car or pickup tires for residential users, farmers and those that do not charge fees for tire disposal; fees will still be charged for retailers, tire dealers and those that charge a fee for tire disposal.  No free waste will be accepted from commercial contractors or businesses (including mobile homes).  No free waste will be accepted for large demo projects (homes, out buildings, tree belts etc.).  In the event circumstances beyond the control of Brown County (flood, tornado, fire, other) would occur during the FREE Cleanup period the Brown County Commission would reserve the right to end the free cleanup period at such time and implement the regular fee structure.  All members present voting aye.  Motion carried.

SOLID WASTE SPECIAL ASSESSMENT FEES – 2019 Commissioner Sutton offered the following Resolution: RESOLUTION #41-18.  WHEREAS, Title 3, Solid Waste Management System, Chapter 3.07011 of the Second Revision Brown County Ordinances, effective March 12, 1997, as amended, requires the Board of County Commissioners to establish the Solid Waste Special Assessment fee schedule for the following year, prior to the second Tuesday in September.  NOW, THEREFORE BE IT RESOLVED, that the following Solid Waste Special Assessment fees shall be effective January 1, 2019 through December 31, 2019, for the Brown County Sanitary Landfill:

SOLID WASTE SPECIAL ASSESSMENT FEE SCHEDULE

(Assessment plus applicable sales tax billed with the Real Estate Tax Notice)

1. Households within Incorporated Cities or Civil Townships that require curb service @ $33.00 per year

2. Households within Incorporated Cities or Civil Townships that do not require curb service  @ $83.00 per year

3. Condominiums taxed as single units within Incorporated Cities or Civil Townships that require curb service @ $33.00 per year

4. Condominiums taxed as single units within Incorporated Cities or Civil Townships that do not require curb service @  $83.00 per year  

5. Apartment Units and Assisted Living Units within incorporated Cities that require curb service @ $15.00 per unit per year

6. Seasonal Lake Cabins @ $50.00 per year

7. Mobile Home parks, outside incorporated municipalities, which provide or require lot side waste pickup during the entire assessment period, for deposit into a permitted landfill solid waste facility @ $33.00 per unit per year

8. Mobile Home parks, outside incorporated municipalities, which do not provide or require lot side waste pickup during the entire assessment period, for deposit into a permitted landfill solid waste facility @ $83.00 per unit per year

Dated this 14th day of August 2018.  Seconded by Commissioner Fischbach.  Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye.  Resolution adopted.

2018 TURN LANE IMPROVMENTS PROJECT: Moved by Kippley, seconded by Fischbach to approve and authorize the Chair sign Notice to Proceed to B&B Contracting, Inc. for the 2018 Turn Lane Improvements Project.  All members present voting aye.  Motion carried.  Moved by Sutton, seconded by Kippley to approve and authorize the Chair sign the following Right of Way Agreements in conjunction with the 2018 Turn Lane Improvements Project: Gail Conklin, 4810 130th Street NE, Aberdeen, SD @ $500.00 for land conveyed, temporary construction easement, highway use deed and highway plat of parcel; Ag Processing Inc, a cooperative, 12700 W Dodge Road, Omaha NE @ $1.00 for land conveyed, temporary construction easement, highway use deed and highway plat of parcel.   All members present voting aye.  Motion carried.

CAPITAL ACCUMULATION REDESIGNATED/RESCINDED: Commissioner Sutton offered the following Resolution:  RESOLUTION #42-18.  WHEREAS, SDCL 7-21-51 authorizes County Commissions, by Resolution, to accumulate funds for a period longer than one year for a capital outlay purpose which is otherwise authorized by law; and  WHEREAS, the Brown County Commission enacted Resolution #51-17 authorizing the Auditor create a capital accumulation account in amount of $200,000.00 per year for five years (2018 – 2022) in the General Fund for the purpose of improvements to the Fairgrounds Grandstand; and WHEREAS, the initial $200,000.00 was appropriated in the 2018 budget, but an opportunity to purchase an office building to alleviate overcrowding in the Courthouse arose, which necessitates the need to re-designate the purpose of the capital outlay accumulation to the purchase of the building; and WHEREAS, the payments for the purchase of the building are due annually and this does not fit the definition of a capital outlay accumulation.   NOW, THEREFORE BE IT RESOLVED that the initial $200,000.00 capital outlay accumulation be designated for the first annual building purchase payment; and BE IT FURTHER RESOLVED, that Resolution #51-17 be rescinded, as the annual payments for the purchase of the building shall be budgeted each year, therefore the capital outlay accumulation is not needed at this time.  Dated this 14th day of August 2018.  Seconded by Commissioner Hansen.  Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye.   Resolution adopted. 

OPERATING TRANSFERS: Moved by Sutton, seconded by Fischbach to approve and authorize the following operating transfers from the General Fund #101-911-191 in total amount of $2,389,269.65 to the following: Road and Bridge Fund #201-371 @ $2,000,000.00; E-911 Fund #207-371@ $267,130.67; EM Fund #226-371 @ $122,138.98, as reflected in the 2018 General Fund Budget.  All members present voting aye.  Motion carried.

RFP-INDIGENT DEFENSE SERVICES: Moved by Sutton, seconded by Hansen to approve the proposal received for Indigent Defense Services for 2019 and 2020, with execution of contracts to follow at a later date.  All members present voting aye.  Motion carried.

ABERDEEN AIRPORT TRANSPORTATION DIRECTOR: Cody Roggatz, Aberdeen City Transportation Director thanked the Commission and other Department Managers for their cooperation in projects during his tenure as Aberdeen City Transportation Director.  The Commission wished Cody well in his new endeavor and stated it has been a pleasure working with him.   

2019 PROVISIONAL BUDGET: Moved by Kippley, seconded by Sutton to approve the 2019 Provisional Budget and authorize advertising public hearing to be held in the Commissioner’s Chambers, Courthouse Annex, at 8:45 A.M. on September 4, 2018.  Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye.  Motion carried.

ADJOURNMENT: Moved by Sutton, seconded by Kippley to adjourn the Brown County Commission at 9:50 a.m.  All members present voting aye.  Motion carried.
