JUNE 19, 2018 – GENERAL MEETING
Meeting called to order by Commission Chair Fjeldheim at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen, Sutton, Fischbach and Kippley. Commissioner Hansen led the Pledge of Allegiance.
Congratulations were extended to Jeannette McClain for receiving her United States Citizen Certification at the Naturalization Ceremony held at Mount Rushmore on June 14, 2018.
MINUTES: Moved by Sutton, seconded by Fischbach to approve the General Meeting Minutes of June 12, 2018. All members present voting aye. Motion carried.

HR REPORT: Moved by Sutton, seconded by Hansen to approve the following Commission Assistant/HR Office Report, which includes the following personnel changes:
• Acknowledge the following resignations: Thersia Cox, effective June 12; Carlos Santiago, effective June 4; Charlie Tveit, effective June 13, 2018; and further approve request to fill vacancies.
• Approve hiring Amanda Aragon, full-time Deputy Treasurer, effective June 25, 2018 at $15.14 per hour; and Lori Goldade, part-time Deputy Treasurer, effective June 25, 2018 at $15.41 per hour; Fadia Champlain, part-time JDC Correctional Officer, effective June 19, 2018 at $13.69 per hour.

SPECIAL MALT BEVERAGE/WINE LICENSE: Moved by Fischbach, seconded by Kippley to approve and authorize the Chair sign the following Special Malt Beverage/Wine License Application: Aberdeen Hockey Association - Brown County Fairgrounds (Clubhouse/Beer Garden) SW ¼ Sec 1-T123N-R64W, effective August 13, 14, 15, 16, 17, 18 & 19, 2018 (map indicating specific area licensed on file with applications). All members present voting aye. Motion carried.
LEASE AGREEMENTS: Moved by Sutton, seconded by Kippley to approve and authorize the Chair sign the following agreements: Aberdeen Downtown Association for lease of the W ½ of Parking Lot North of Museum (Concert Series) on June 14, July 12, Aug 9 and Aug 25, 2018; Aberdeen Downtown Association for lease of trailer with 40 corral panels for Concert Series on June 14, July 12, Aug 9 and Aug 25, 2018. All members present voting aye. Motion carried.
SHERIFF REPORTS: Moved by Hansen, seconded by Fischbach to approve the following May 2018 Sheriff Reports: Incidents and offenses, Prisoner care, JDC, and Money deposited with the County Treasurer. All members present voting aye. Motion carried.

ORD 119 – ADOPTION: Moved by Kippley, seconded by Fischbach to adopt Ordinance #119, An Ordinance to amend Title 4 – Zoning, Second Revision Brown County Ordinances, to rezone the following described property from its present zoning designation of Chapter 4.06 (AG-P) Agricultural Preservation District to Chapter 4.07 (M-AG) Mini-Agricultural District: N ½ of Levey’s Outlot 1 in the SE ¼ of Sec 24-T123N-R65W of the 5th P.M., Brown County, SD. (13351 382nd Ave). Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye. Ordinance adopted.
SPECIAL EVENT LIQUOR LICENSE HEARING: Time and place, as advertised to consider application for Special Event Liquor License Application. Moved by Kippley, seconded by Sutton to approve and authorize the Chair sign Special Liquor License Application, submitted by Stacy Gossman DBA Big Fella’s for event for Stutsman Harley Davison Grand Opening to be held at 717 385th Ave S, described as Lot 1 Browning 1st Addition, NW ¼ Sec 22-T123-R64W of the 5th P.M., (Lot 1 Great Plains Ag Addition and Winters Outlot 1), Brown County, SD (717 385th Ave S). Special License effective June 23, 2018. All members present voting aye. Motion carried.
ROAD DISCUSSION: Lee Zacher, area resident discussed the condition of a portion of 385th Ave between 130th Street and 131st Street, Aberdeen Township. Mr. Zacher was advised to meet with the Aberdeen Township Officials.
SA BUDGET DISCUSSION: States Attorney Chris White met to answer any questions in regard to the States Attorney Department 2019 Budget request.
OATH OF OFFICE: Gene Loeschke was official sworn in by Chair Fjeldheim as the Brown County Director of Equalization.
BUILDING PURCHASE/SALE: Moved by Hansen, seconded by Sutton to authorize the Chair sign lease to own purchase agreement ($2500.00 earnest money) for property at 122 S 1st Street (Lots 5-6 Block 15, OP to the City of Aberdeen) in total amount of $800,000.00, with $170,000.00 down payment in 2018 and $210,000.00 per year in 2019, 2020 and 2021 (3% interest). Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-nay, Kippley-aye, Fjeldheim-aye. Motion carried. Moved by Sutton, seconded by Kippley to sell the Millim Office Building located at 1019 1st Ave NE if purchase agreement accepted. Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-nay, Kippley-aye, Fjeldheim-aye. Motion carried.
EXECUTIVE SESSION: Moved by Kippley, seconded by Hansen to go into executive session to discuss contractual matters and to consult with legal counsel, per SDCL 1-25-2(3) with Chris White and Gary Vetter in attendance. The Chair declared the executive session closed, with the following action taken as a result of the discussion: Moved by Hansen, seconded by Sutton to contact bonding company for a $100,000.00 Bond covering the Director of Equalization; and also stated the States Attorney is drafting answer to lawsuits in regard to the Ag Land Assessments. All members present voting aye. Motion carried.
ADJOURNMENT: Moved by Sutton, seconded by Hansen to adjourn the Brown County Commission at 11:15 a.m. All members present voting aye. Motion carried.
