Meeting called to order by Commission Chair Fjeldheim at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen, Sutton, Fischbach and Kippley. Commissioner Kippley led the Pledge of Allegiance.
MINUTES: Moved by Sutton, seconded by Kippley to approve the Joint City/County Meeting Minutes of April 23, 2018 and the General Meeting Minutes of April 24, 2018. All members present voting aye. Motion carried. Moved by Fischbach, seconded by Kippley to approve the Brown County Board of Equalization Meeting Minutes of April 24, 2018. Roll call vote: Commissioners Hansen-abstain, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye. Motion carried.

EXECUTIVE SESSION: Moved by Kippley, seconded by Sutton to go into executive session for personnel discussion, per SDCL 1-25-2(1) with Chris White and Gary Vetter in attendance. All members present voting aye. Motion carried. The Chair declared the executive session closed, with no action taken as a result of the discussion.
HR REPORT: Moved by Kippley, seconded by Sutton to approve the following Commission Assistant/HR Office Report, as amended, which includes the following personnel changes:
Approve hiring Karla Nelson as States Attorney Summer Intern, effective May 14, 2018 @ $500.00 per week.
Approve hiring Anthony Cooper as part-time seasonal Fairgrounds employee, effective May 14, 2018 @ $11.67 per hour.
Acknowledge resignation of Correctional Officer Eric Kiefer, effective May 6, 2018; and further approve request to fill vacancy.

FAIR BOARD BY-LAWS: Moved by Sutton, seconded by Kippley to approve the Fair Board By-Laws, effective May 1, 2018. All members present voting aye. Motion carried.
MIDCO AGREEMENT: Moved by Hansen, seconded by Fischbach to approve and authorize the Chair sign the Midco Business Service Order, as amended from $220 per month to $175.00 per month. All members present voting aye. Motion carried.
LOTTERY APPLICATION: Moved by Fischbach, seconded by Kippley to approve and authorize the Chair sign application, submitted by Aberdeen Amateur Hockey Association for Lottery to be held November 17, 2018. All members present voting aye. Motion carried.
ABATEMENTS: Moved by Sutton, seconded by Kippley to approve and authorize the Chair sign the following Abatements: Thomas Hinz @ $891.82 (assessment error); Charlotte Martin @ $2,060.13 (assessment error). All members present voting aye. Motion carried.
LEASE AGREEMENT: Moved by Kippley, seconded by Fischbach to approve and authorize the Chair sign the following agreement: Aberdeen American News for lease of the Expo Building on May 11-12, 2018. All members present voting aye. Motion carried.
FAIR CONTRACTS: Moved by Sutton, seconded by Fischbach to approve and authorize the Chair sign the following contracts for the 2018 Brown County Fair: Sarah Preszler @ $30.00 (judge); Best Western Ramkota Hotel @ $18,697.80 (rooms). All members present voting aye. Motion carried.
SEASONAL LOAD LIMIT EXTENSION: Commissioner Hansen offered the following Resolution: RESOLUTION #26-18. WHEREAS, SDCL 32-22-24 authorizes the proper authority to establish maximum axle and axle group loadings during the period of each year from February fifteenth to April thirtieth, inclusive, and WHEREAS, that authority may be exercised without formal resolution if the highway authority erects or causes to be erected and maintained signs designating the restrictions; and
WHEREAS, if highway and climatic conditions warrant, the proper highway authority may extend the time period mentioned by ordinance or resolution. NOW, THEREFORE BE IT RESOLVED, that the Brown County Commission, per SDCL 32-22-24 extends the seasonal load restrictions (6-ton per axle and 40 MPH for trucks) on all Brown County Oil Roads, except the Belt Loop around Aberdeen and other specified roads (as listed in the March 13, 2018 Commission Meeting Minutes) until May 8, 2018 or until roads become stable. FURTHER, BE IT RESOLVED that the Brown County Commission requests the South Dakota Department of Public Safety and the South Dakota Highway Patrol to enforce any and all weight limits for the extended period of time. Seconded by Commissioner Sutton. Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye. Motion carried. Resolution adopted.
HIGHWAY UPDATE: Dirk Rogers, Highway Superintendent discussed the following: repercussions of road widening; West Bridge at Richmond; closing a section Hwy 14 (north of US Hwy 12) north and south of RR crossing for approximately six weeks.
EXECUTIVE SESSION: Moved by Kippley, seconded by Sutton to go into executive session to consult with attorney, per SDCL 1-25-2(3) with Chris White, Gary Vetter, Sheila Enderson, Patti VanMeter, Sara Swisher and Maxine Fischer in attendance. All members present voting aye. Motion carried. The Chair declared the executive session closed, with no action taken as a result of the discussion.
AG LAND ASSESSMENTS: Moved by Kippley, seconded by Sutton to authorize a partial refund and/or abatement of the County portion of the 2017 payable 2018 Ag land property taxes, upon receipt of a signed mutual release agreement from property owners, in a total amount not to exceed $513,411.35; and further authorize the Chair sign a letter to the SD Department of Revenue stating the County does not feel it is legally obligated to refund, but wishes to do the right thing by providing the refund to negatively impacted landowners and to request the State to share in the responsibility of paying the refund and in doing so be made a part of the terms of the mutual release agreement. Roll call vote: Sutton-aye, Kippley-aye, Fjeldheim-aye, Commissioners Hansen and Fischbach abstaining from the vote and further stating they will not be requesting the partial refund of taxes on their properties. Motion carried.
ADJOURNMENT: Moved by Kippley, seconded by Sutton to adjourn the Brown County Commission at 10:00 a.m. All members present voting aye. Motion carried.
