Meeting Minutes

MAY 22, 2018 – GENERAL MEETING

Meeting called to order by Commission Chair Fjeldheim at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD.  Present were Commissioners Hansen, Sutton, Fischbach and Kippley.  Commissioner Hansen led the Pledge of Allegiance.   

MINUTES:  Moved by Sutton, seconded by Kippley to approve the General Meeting Minutes of May 15, 2018 and the Special Meeting Minutes of May 18, 2018.  All members present voting aye.  Motion carried.

HR REPORT: Moved by Kippley, seconded by Fischbach to approve the following Commission Assistant/HR Office Report, which includes the following personnel changes:

• Amend resignation date of Register of Deeds Carol Sherman to June 30, 2018.

• Acknowledge amendment to Policy E-13 – Weather Emergencies; Policy F-10 – Employee Use of County Vehicles; Policy C-9 – under Sundial Timekeeping System (Responsibilities of Employees – Daily Clock In/Out; Policy F-1 – Authorization under Travel and Meal Expenses.                               

All members present voting aye.  Motion carried. 

FAIR CONTRACTS: Moved by Fischbach, seconded by Sutton to approve and authorize the Chair sign the following contracts for the 2018 Brown County Fair: WPRA @ $2,000.00 (barrel racing); YeeYee Energy Drink (product promotion with Granger Smith); Kidsight/SD Lions Foundation (children’s vision screenings).  All members present voting aye.  Motion carried.

ORD 119- SET HEARING DATE: Moved by Fischbach, seconded by Sutton to set public hearing for consideration of application, submitted by Jeremy Ewalt for Ordinance #119, An Ordinance to amend Title 4 – Zoning, Second Revision Brown County Ordinances, to rezone the following described property from its present zoning designation of Chapter 4.06 (AG-P) Agricultural Preservation District to Chapter 4.07 (M-AG) Mini-Agricultural District: N ½ of Levey’s Outlot 1 in the SE ¼ of Sec 24-T123N-R65W of the 5th P.M., Brown County, SD. (13351 382nd Ave), to be held in the Brown County Commission Chambers, Courthouse Annex at 8:45 a.m. on June 12, 2018.  All members present voting aye.  Motion carried.  

LOTTERY APPLICATION: Moved by Hansen, seconded by Kippley to approve and authorize the Chair sign the following applications: Boys & Girls Club of Aberdeen Area for a lottery to be held at Moccasin Creek Country Club on June 25, 2018; American Legion, Sidney L Smith Post #24 for lottery to be at the horse races on May 27, 2018.  All members present voting aye.  Motion carried.

EMPLOYEE HEALTH INSURANCE: Moved by Sutton, seconded by Kippley to approve and authorize the Chair sign WageWorks Agreement (Flex Spending Accounts) with Wellmark Blue Cross and Blue Shield in conjunction with the employee health insurance coverage, effective July 1, 2018 – June 30, 2019; and further increasing the FSA administration fee from $4.75 to $5.25.  All members present voting aye.  Motion carried.

LIEN RELEASE: Commissioner Sutton offered the following Resolution:  RESOLUTION #27-18. WHEREAS, Brown County has filed a Relief Lien against an individual residing at 630 S Wells #9 in amount of $936.67, dated May 28, 2009 – August 22, 2012; and  WHEREAS, the attorney for the Personal Representative of the Estate states the estate is insolvent and there are no net assets available to pay the Claim; and WHEREAS, the attorney is prepared to recommend the Personal Representative pay the sum of $150.00 to Brown County to settle its Claim in full; and WHEREAS, Brown County has determined it to be in the best interest of the taxpayers to release lien in amount of $936.67 in its entirety, upon receipt of $150.00 from the Personal Representative of the Estate.  NOW, THEREFORE BE IT RESOLVED that the Poor Relief Lien in amount of $936.67 shall be considered paid in full and a Satisfaction of Lien shall be issued, upon receipt of $150.00 to Brown County from the Personal Representative of the Estate in amount of $150.00.  Seconded by Commissioner Kippley.  Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye.  Resolution adopted.

PLATS: Commissioner Fischbach offered the following Resolution: Resolution #28-18. BE IT RESOLVED by the County Commission of Brown County, SD, that the plat showing “C. Jark Addition in the NW ¼ of Sec 8-T121N-R62W of the 5th P.M., Brown County, SD”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.  Seconded by Commissioner Sutton.  Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Fjeldheim-aye, Kippley-aye.  Resolution adopted.  Commissioner Fischbach offered the following Resolution:  Resolution #29-18. BE IT RESOLVED by the County Commission of Brown County, SD, that the plat showing “Rix Outlot 2 in the SW ¼ of Sec 6-T124N-R60W of the 5th P.M., Brown County, SD”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.  Seconded by Commissioner Sutton.  Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Fjeldheim-aye, Kippley-aye.  Resolution adopted.  

TOWNSHIP BONDS:  Moved by Hansen, seconded by Kippley to approve the following Township Bonds (Treasurer and Clerk): ABERDEEN #20- William Donaldson, Marguerite Donaldson; Mercier #21 Rodney Artz, Daryl Reick.  All members present voting aye.  Motion carried.

ORD 117- ADOPTION: Moved by Hansen, seconded by Fischbach to adopt Ordinance #117, An Ordinance to amend Title 4 – Zoning, Second Revision Brown County Ordinances, to rezone the following described property from its present zoning designation of Chapter 4.06 (AG-P) Agricultural Preservation District to Chapter 4.07 (M-AG) Mini-Agricultural District: Lot 2 Schinkel Second Subdivision in the E ½ E ½ of Sec 35-T122N-R61W of the 5th P.M., Brown County, SD (14187 and 14184 405th Ave).  Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Fjeldheim-aye, Kippley-aye.  Resolution adopted.

ORD 118- ADOPTION: Moved by Sutton, seconded by Kippley to adopt Ordinance #118, An Ordinance to amend Title 4 – Zoning, Second Revision Brown County Ordinances, to rezone the following described property from its present zoning designation of Chapter 4.06 (AG-P) Agricultural Preservation District to Chapter 4.07 (M-AG) Mini-Agricultural District: Lots 1-4 & 7-8 of Camelot Subdivision and Lot 5 of Sperry First Subdivision of Camelot Subdivision in the SE ¼ of Sec 19-T123N-R62W of the 5th P.M., Brown County, SD (Sperry Lane Road).  Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Fjeldheim-aye, Kippley-aye.  Resolution adopted.

GROW SOUTH DAKOTA: Marcia Erickson presented statistical information on Grow South Dakota’s 2017 Northeast South Dakota Community Action activities in Brown County and Kelly Weaver presented information on the Northeast South Dakota Economic Corporation Program and The Big Idea Competition for SD high school students.  Both thanking the Commission for past and future funding for Grow South Dakota.

AG LAND ASSESSMENT DISCUSSION: A group of residents met in regard to the SD Department of Revenue’s response to the letter sent previously by the Commission in regard to the Brown County Ag Land Assessments.  No action was taken at this time.

EXECUTIVE SESSION: Moved by Fischbach, seconded by Sutton to go into executive session to consult with attorney, per SDCL 1-25-2(3) with Chris White and Gary Vetter in attendance.  All members present voting aye.  Motion carried.  The Chair declared the executive session closed, with no action taken as a result of the discussion.

ADJOURNMENT: Moved by Sutton, seconded by Hansen to adjourn the Brown County Commission at 11:18 a.m.  All members present voting aye.  Motion carried.
