Meeting called to order by Commission Chair Fjeldheim at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen, Sutton, Fischbach and Kippley. Commissioner Sutton led the Pledge of Allegiance.

LEASE AGREEMENT: Moved by Sutton, seconded by Kippley to approve and authorize the Chair sign the following agreements: Leah Swanson for lease of the Richmond Lake Youth Camp Lodge on August 4-5, 2018. All members present voting aye. Motion carried.
AUDITORS REPORT OF ACCOUNT: Moved by Fischbach, seconded by Hansen to approve the March 2018 Auditor’s Report of Account with the County Treasurer in total amount of $13,152,521.66 (total amount of actual cash @ $4,931.60, Cash items (bad checks) @ $68.40, US Bank @ $30,590.98, Dacotah Bank @ $4,519,809.09, Petty Cash/Change Funds @ $2,600.00, Fund Investments @ $8,594,521.59). SPECIAL MALT BEVERAGE LICENSE: Moved by Kippley, seconded by Fischbach to change effective date on Bull Riding Event Special Malt Beverage License issued to the Boys & Girls Club of Aberdeen from April 13-14 to April 20-21, 2018, as event postponed due to weather. All members present voting aye. Motion carried.
BID – LANDFILL CELL 3 CONSTRUCTION PROJECT ADDENDUM: Moved by Sutton, seconded by Hansen to approve Addendum Number 1 for the Brown County Landfill Cell #3 Construction & Drainage Improvement Project. All members present voting aye. Motion carried.
BID – LANDFILL CELL 3 CONSTRUCTION PROJECT: Time and place, as advertised to open, read and consider sealed bids for the Landfill Cell 3 Construction & Drainage Improvement Project. Bids were received from RTS Shearing LLC, Jamestown, ND; Central Specialties Inc, Alexandria, MN and B&B Contracting Inc, Aberdeen, SD. Moved by Fischbach, seconded by Sutton to refer all bids to Mike Scott, Landfill Manager for review and recommendation. All members present voting aye. Motion carried. Moved by Fischbach, seconded by Hansen to award low bid, submitted by B&B Contracting in amount of $2,064,953.84 for the Landfill Cell 3 Construction & Drainage Improvement Project; rejecting RTS Shearing LLC in amount $2,860,604.56 and Central Specialties Inc in amount of $2,921,121.86. All members present voting aye. Motion carried.
ORD 116- FIRST READING: Moved by Fischbach, seconded by Kippley to approve First Reading of Ordinance #116, An Ordinance to amend Title 4 – Zoning, Second Revision Brown County Ordinances, to rezone the following described property from its present zoning designation of Chapter 4.06 (AG-P) Agricultural Preservation District to Chapter 4.07 (M-AG) Mini-Agricultural District: Thorson’s Outlot 2 except the East 114’ in the NW ¼ of Sec 19-T122N-R63W of the 5th P.M., Brown County, SD (38809 139th Street). All members present voting aye. Motion carried.
SHERIFFF DEPARTMENT SALARIES: Moved by Sutton, seconded by Hansen to increase the salary of the Sheriff Department Investigators by $2.00 per hour (Jonathan Lemke @ 23.72); and to increase the salary of the Sheriff Department Deputies by $1.00 per hour (Mike Hill, Gavin Wright, Wes Graff, Ermelinda Marcuson @ $21.33; Brandon Black @ 22.02, Keith Baker @ 22.37; Linn Kamin @ 23.07; Nathan Smith @ 24.86; Ben Smith @ 24.91; Craig Nelson @ 25.11; Brian Koens, Terrence Evans @ 25.16; Scott Kolb @ 25.76), effective April 22, 2018. All members present voting aye. Motion carried. Moved by Kippley, seconded by Fischbach to remove salary stipend received by the Sheriff for overseeing the Communications Center, effective on the first payroll of 2019. After discussion the motion was withdrawn.
AUDIT ENTRANCE CONFERENCE: Dave Schlosser, SD Department of Legislative Audits met with the Commission for Entrance Conference for the Audit being conducted for fiscal year 2017.
APPLICATIONS FOR OCCUPANCY: Moved by Kippley, seconded by Fischbach to approve and authorize the Chair sign the following applications, submitted by WEB Water Development for occupancy of Brown County 21 (138th Street) in Sec 10-T122N, R63W; North Bridge Road in Sec 13-T124N-R65W; and Brown County 10 in Sec 24-T127N-R64W to provide potable water lines. Roll call vote: Commissioners Hansen-abstain, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye. Motion carried.
BID – COUNTY ROAD #23 COLD INPLACE PROCESS PROJECT: Moved by Fischbach, seconded by Sutton to authorize advertising a public hearing to open, read and consider bids for the County Road #23 Cold Inplace Process (CIP) Project; to be held in the Commission Chambers, Courthouse Annex at 8:45 a.m. on May 8, 2018. All members present voting aye. Motion carried.
SURPLUS SALE: Moved by Sutton, seconded by Hansen to accept low quote, submitted by Buntrock Auction Service at 4% on gross sales ($1,000 minimum) for auction services at the Brown County Surplus Sale to be held at the Highway Complex (3133 8th Ave NE) on May 11, 2018 at 10:00 a.m.; rejecting Jark/Worlie Auction @ 6% on gross sales ($1,500.00 minimum), Thorpe Realty & Auction did not submit a quote. All members present voting aye. Motion carried.
FAIR BOARD BY-LAWS: Derek Ricci, Fair Manager discussed the proposed changes to the Fair Board By-Laws, with no action taken at this time.
EXECUTIVE SESSION: Moved by Kippley, seconded by Sutton to go into executive session to consult with attorney, per SDCL 1-25-2(3) with Chris White and Gary Vetter in attendance; and further to discuss personnel, per SDCL 1-25-2(1) with Chris White, Gary Vetter, Maxine Fischer and Sara Swisher in attendance. All members present voting aye. Motion carried. The Chair declared the executive session closed, with no action taken as a result of the legal discussion and the following action taken as a result of the personnel discussion: Moved by Kippley, seconded by Sutton to reimburse two employees one-half the cost in regard to an AFLAC premium error in total amount of $860.36 (employee share 430.18 county share 430.18). All members present voting aye. Motion carried.
E-MAIL ISSUE QUESTION: Matt Deilke inquired about the status of the e-mail issue discussed at the April 3, 2018 meeting. The topic will be on the agenda April 24, 2018.
