Meeting called to order by Commission Chair Fjeldheim at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen, Sutton, Fischbach and Kippley. Commissioner Sutton led the Pledge of Allegiance.

Approve hiring Erin Ackerman as full-time Dispatcher, effective February 26, 2018 at $16.46 per hour.
Approve the following Employee Step Increases, effective February 25, 2018: John Florey @ $18.43 per hour, Cory Erhardt @ $18.16 per hour, Samual Hoppock @ $16.49 per hour.

CLAIM ASSIGNMENT: Moved by Kippley, seconded by Sutton to approve and authorize the Chair sign documentation to assign claim against an individual to Credit Collections Bureau for purpose of collecting a lien. All members present voting aye. Motion carried.
LEASE AGREEMENT: Moved by Kippley, seconded by Sutton to approve and authorize the Chair sign the following agreement: Aberdeen Home Builders Association for lease of the Expo Building on March 3 – 4, 2018. All members present voting aye. Motion carried.
ORD 115- SET HEARING DATE: Moved by Sutton, seconded by Fischbach to set public hearing for consideration of Ordinance #115, An Ordinance to amend Title 6 Traffic Regulations, Second Revision Brown County Ordinances, by adding Chapter 6.05 Prohibiting the Lawful Use of Engine and Compression Brakes (Jake Brakes), to be held in the Brown County Commission Chambers, Courthouse Annex at 8:45 a.m. on March 13, 2018. All members present voting aye. Motion carried.
QUIT CLAIM DEEDS: Moved by Kippley, seconded by Hansen to approve and authorize the Chair sign Quit Claim Deeds for the following properties sold by tax deed on February 16, 2018: Homes Are Possible, Inc – Lt 4 Blk 6 Boyd’s Subdivision of Blk 6 Nicollet Park Addition to Aberdeen, according to the plat thereof of record, Brown County, SD @ $10,500.00; Monte and Janet Riggs – The 150’ first South of the North 1342.46’ of the East 130’ of the West 313’ of the NW ¼ of Sec 13-T126-R64W of the 5th P.M., according to the plat thereof of record, Brown County, SD @ $1,066.00; Dakota Plains Feed and Grain LLC – Lot M-1 NW of the SE & NE of the SW in Sec 22-T128R-R61W of the 5th P.M., Town of Hecla, Brown County, SD @ $2,856.00. LANFILL COMPLIANCE REPORT: Moved by Fischbach, seconded by Hansen to approve and authorize the Chair sign the 2017 Compliance Certification Report for the Brown County Solid Waste Landfill Permit #28.1101-03. All members present voting aye. Motion carried.
ORD 114: Moved by Fischbach, seconded by Sutton to adopt Ordinance #114, An Ordinance to amend Title 4 – Zoning, Second Revision Brown County Ordinances, to rezone the following described property from its present zoning designation of Chapter 4.06 (AG-P) Agricultural Preservation District to Chapter 4.07 (M-AG) Mini-Agricultural District: Ball Pioneer Farm Outlot A in the SE ¼ of Sec 7-T121N-R60W of the 5th P.M., Brown County, SD (14399 407th Ave). Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye. Ordinance adopted.
ASSESSMENT PLAN: Attorney Harvey Oliver met in regard to the recent assessment plan discussions, suggesting that a consensus of the issues, legal status, and the plan going forward be determined. Attorney General Jackley has offered assistance to the Commission, States Attorney and Department of Revenue to address the items. Based upon the letter requested and received from the Department of Revenue, the Interim Director of Equalization has made adjustments to the 2018 payable 2019 assessments.
OUTSOURCE PAYROLL: Moved by Hansen to sign authorize the Chair sign agreement to outsource payroll. Motion withdrawn, as more research must be completed.
EXECUTIVE SESSION: Moved by Kippley, seconded by Sutton to go into executive session to consult with attorney, per SDCL 1-25-2(3) with Chris White, Gary Vetter and Gene Loeschke in attendance. All members present voting aye. Motion carried. The Chair declared the executive session closed, with no action taken as a result of the discussion.
ADJOURNMENT: Moved by Hansen, seconded by Sutton to adjourn the Brown County Commission at 10:28 a.m. All members present voting aye. Motion carried.
