We know it, and the state refuses to accept it," she said. • But Pennington County State's Attorney Mark Vargo told jurors that Birdshead knew what he was doing when he took a shotgun to the motel that night with the intent to sell drugs, and that Maruffo's death was not justifiable. • "The truth is Charles Birdshead created a reputation for violence, guns, power and a gangster mask," Vargo said. • Birdshead also is accused of having a sexual relationship with a teenager -- an alleged crime that authorities said they uncovered during their investigation into Maruffo's slaying. Birdshead will have a separate trial on charges of rape and distributing drugs to a minor. •
Bison tabbed for top spot in poll by FCS coaches
• FARGO, N.D. (AP) -- The back-to-back Football Championship Subdivision winner is picked by coaches as the No. 1 team in a preseason poll. • North Dakota State received 23 of 26 first-place votes in the poll, which is based on a voting panel of FCS coaches. • The Bison return 18 starters from a team that went 14-1 and rolled over Sam Houston State in the championship game at FC Dallas Stadium in Frisco, Texas, in January. • Montana State was picked No. 2, followed by Eastern Washington, Sam Houston and Wofford. Other first place votes went to Montana State, Sam Houston and No. 19 Eastern Kentucky. • Other Missouri Valley Football Conference teams ranked are South Dakota State at No. 7, Illinois State at No. 10, Northern Iowa at No. 16, and Youngstown State at No. 24. •
Federal judge dismisses SD early voting lawsuit
• PIERRE, S.D. (AP) -- A federal judge on Tuesday dismissed a lawsuit that sought to ensure that residents of part of the Pine Ridge Indian Reservation have the same access to early voting as people in other South Dakota counties. • U.S. District Judge Karen Schreier dismissed the lawsuit after finding that state and local officials have agreed to provide an in-person absentee voting station in Shannon County for the 2014, 2016 and 2018 election cycles. • The judge said she couldn't proceed to consider the case because no one knows whether election laws or other conditions will change after the 2018 election.
