Meeting called to order by Commission Chair Fjeldheim at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen, Sutton and Fischbach. Commissioner Kippley was absent. Commissioner Fjeldheim led the Pledge of Allegiance.

HR REPORT: Moved by Hansen, seconded by Fischbach to approve the following Commission Assistant/HR Office Report, which includes the following personnel changes:
Approve the following Employee Step Increases, effective July 1, 2018: Paul Wipf @ $21.39 per hour; Melony Flinn @ $20.09 per hour; John Clark @ $18.23 per hour; Kathy Neitzel @ $21.97 per hour.

FAIR CONTRACTS: Moved by Sutton, seconded by Fischbach to approve and authorize the Chair sign the following contracts for the 2018 Brown County Fair: Hub City Radio @ $8,410.00 + 16 passes (advertising); Lew’s Fireworks Inc Display @ $5,020.00 (fireworks display); Judy Gulleson @ $40.00 (judge). All members present voting aye. Motion carried.
LEASE AGREEMENTS: Moved by Fischbach, seconded by Sutton to approve and authorize the Chair sign the following agreements: Spink County 4-H Horse Club for lease of the Akkerman Arena on June 21, 2018; Brown County 4-H for lease of the Akkerman Arena on July 6, 7 & 8, 2018; 4-H Triple Threat Livestock Show for lease of the Expo Addition, the Petting Zoo and the Hog/Sheep Barn on June 22-23, 2018; Child Evangelism Fellowship (CEF) for lease of the Richmond Lake Youth Camp on July 15-20 and July 22-27, 2018; Bath SD Baseball for lease of the Panel trailer on July 14-15, 2018; Brown County 4-H Horse Club for lease of the Akkerman Arena on June 20, 2018. All members present voting aye. Motion carried.
RELEASE OF LIEN: Commissioner Hansen offered the following Resolution: RESOLUTION #31-18. WHEREAS, the Brown County Register of Deeds records show a Yankton Lien against an individual in the amount of $125.76, dated June 12,1967 but not filed until November 17, 1971; and WHEREAS, documentation dated May 21 1970, indicates that the individual was a legal resident of Faulk County and the lien was transferred accordingly. NOW, THEREFORE BE IT RESOLVED that the Yankton Lien in amount of $125.76 filed November 17, 1971 was a clerical error and a reversing entry shall be filed bringing the balance to zero. Seconded by Commissioner Fischbach. Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-absent, Fjeldheim-aye. Resolution adopted.
PLATS: Commissioner Sutton offered the following Resolution: Resolution #32-18. BE IT RESOLVED by the County Commission of Brown County, SD, that the plat showing “Dawn Hagen Outlot A in NE ¼ NE ¼ Sec 24-T122N-R65W, Brown County, SD”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof. Seconded by Commissioner Hansen. Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-absent, Kippley-aye. Resolution adopted. Commissioner Sutton offered the following Resolution: Resolution #33-18. BE IT RESOLVED by the County Commission of Brown County, SD, that the plat showing “Voeller Addition in the S ½ of Sec 29-T127N-R64W of the 5th P.M., Brown County, SD”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof. BC 14N RECONSTRUCTION PROJECT: Moved by Hansen, seconded by Sutton to approve and authorize the Chair sign Change Order #1 for the BC 14N Reconstruction Project, increasing the original bid amount from $141,609.50 to 155,594.30 (increase of $13,984.80 as a result of adjusting material quantities used). All members present voting aye. Motion carried. Moved by Fischbach, seconded by Hansen to approve and authorize the Chair sign Payment Request No.1 (final) in amount of $155,594.30 for completion of the BC 14N Reconstruction Project. All members present voting aye. Motion carried.
EMPLOYEE POLICY MANUAL: Moved by Sutton, seconded by Fischbach to rescind the following portion of motion made in minutes of May 22, 2018 contained within the HR Report: “Policy C-9 – under Sundial Timekeeping System (Responsibilities of Employees – Daily Clock In/Out”; reinstating the original language. All members present voting aye. Motion carried.
APPLICATIONS FOR OCCUPANCY: Moved by Hansen, seconded Sutton to approve application, submitted by NorthWestern Energy for occupancy of Brown County Highway #14 (391st Ave) in Sec 15, 10 & 9-T123N-R63W, Brown County, SD to install natural gas pipeline. All members present voting aye. Motion carried. Moved by Fischbach, seconded by Sutton to approve application, submitted by WEB Water Development for occupancy of Brown County 14 in Sec 26-T123N-R64W, Brown County, SD to provide potable water line. Roll call vote: Commissioners Hansen-abstain, Sutton-aye, Fischbach-aye, Kippley-absent, Fjeldheim-aye. Motion carried. Moved by Sutton, seconded by Hansen to approve applications, submitted by James Valley Telecommunications for occupancy of Brown County Highway #13E in Sec 26/25-T124N-R64W, Brown County, SD; and for occupancy of Brown County Highway #13E in Sec 26/35-T124N-R64W, Brown County, SD to provide telecommunications. All members present voting aye. Motion carried.
MAINTENANCE UPDATE: Judy Dosch, Maintenance Supervisor met to discuss an invoice for fobbing equipment and a request for equipment repair for the Court system. No action was taken at this time.
EXECUTIVE SESSION: Moved by Sutton, seconded by Fischbach to go into executive session for consultation with legal counsel, per SDCL 1-25-2(3) with Chris White and Gary Vetter in attendance. The Chair declared the executive session closed, with no action taken as a result of the discussion.
ADJOURNMENT: Moved by Fischbach, seconded by Sutton to adjourn the Brown County Commission at 9:59 a.m. All members present voting aye. Motion carried.
