Meeting Minutes

JULY 24, 2018 – GENERAL MEETING

Meeting called to order by Commission Chair Fjeldheim at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD.  Present were Commissioners Hansen, Sutton, Fischbach and Kippley.  Commissioner Hansen led the Pledge of Allegiance.     

MINUTES:  Moved by Fischbach, seconded by Kippley to approve the General Meeting Minutes of July 17, 2018.  All members present voting aye.  Motion carried.

HR REPORT: Moved by Kippley, seconded by Hansen to approve the following Commission Assistant/HR Office Report, which includes the following personnel changes:

Acknowledge resignation of Lacey Lopez-Martinez, effective July 20, 3018; and further approve request to fill vacancy.

Approve the following Employee Step Increases, effective July 29, 2018: Daryl Lloyd  @ $21.18 per hour; Russ Ochsner $20.00 per hour; Jeannette McClain @ $15.41 per hour.                             

All members present voting aye.  Motion carried. 

FAIR CONTRACTS: Moved by Fischbach, seconded by Sutton to approve and authorize the Chair sign the following contracts for the 2018 Brown County Fair: Cathy Jorgenson, Lisa Harry @ $40.00, Blake Eisenbeisz @ $100.00 (judges).  All members present voting aye.  Motion carried. 

PLATS: Commissioner Fischbach offered the following Resolution: RESOLUTION #39-18. BE IT RESOLVED by the Board of County Commissioners of Brown County, SD, that the plat showing McIntire’s Outlots in the NE ¼ of Sec 23-T123N-R65W of the 5th P.M., Brown County, SD, having been examined, is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof.  Seconded by Commissioner Sutton.  Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye.  Motion carried.  Commissioner Fischbach offered the following Resolution: RESOLUTION #40-18. BE IT RESOLVED by the County Commission of Brown County, SD, that the plat showing Rolling Meadows Second Addition in the NE ¼ of Sec 1-T123N-R64W of the 5th P.M., Brown County, SD, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.  Seconded by Commissioner Sutton.  Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye.  Motion carried.

SHERIFF REPORTS: Moved by Sutton, seconded by Hansen to approve the following June 2018 Sheriff Reports: Incidents and offenses, Prisoner care, JDC, and Money deposited with the County Treasurer. All members present voting aye. Motion carried.

ABATEMENT: Moved by Hansen, seconded by Fischbach to approve and authorize the Chair sign the following Abatement: Joseph Rigg @ $2,057.77 (fire).  All members present voting aye.  Motion carried.

CLAIM ASSIGNMENT:  Moved by Kippley, seconded by Sutton to approve and authorize the Chair sign documentation to assign claim against an individual to Credit Collections Bureau for purpose of collecting a lien.  All members present voting aye.  Motion carried.

LEASE AGREEMENTS: Moved by Kippley, seconded by Fischbach to approve and authorize the Chair sign agreement with Stacey Franks for lease of the Richmond Lake Youth Camp on July 21-22, 2018; Watertown Human Service Agency for lease of the Richmond Lake Youth Camp on August 8-10, 2018.  All members present voting aye.  Motion carried.

QUIET TITLE ACTION: Moved by Hansen, seconded by Sutton to enter into contract with Vic Fischbach to begin quiet title action on a tax deed property located at 306 6th Street, Hecla, SD.  Roll call vote: Hansen-aye, Sutton-aye, Fischbach-abstain, Fjeldheim-aye, Kippley-aye.  Motion carried.

ORD 120 – ADOPTION: Moved by Sutton, seconded by Fischbach to adopt Ordinance #120, An Ordinance to amend Title 4 – Zoning, Second Revision Brown County Ordinances, to rezone the following described property from its present zoning designation of Chapter 4.06 (AG-P) Agricultural Preservation District to Chapter 4.07 (M-AG) Mini-Agricultural District: Prunty Tract 1 in the S ½ of Sec 25-T123N-R60W of the 5th P.M., Brown County, SD. (41150 135th Street).  Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye.  Motion carried.

ORD 121 – ADOPTION: Moved by Kippley, seconded by Sutton to adopt Ordinance #121, An Ordinance to amend Title 4 – Zoning, Second Revision Brown County Ordinances, to rezone the following described property from its present zoning designation of Chapter 4.06 (AG-P) Agricultural Preservation District to Chapter 4.14 (HC) Highway Commercial District: Rix Outlot 2 in the SW ¼ of Sec 6-T124N-R60W of the 5th P.M., Brown County, SD. (12484 406th Ave).  Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye.  Motion carried.

ORD 122 – ADOPTION: Moved by Hansen, seconded by Kippley to adopt Ordinance #122, An Ordinance to amend Title 4 – Zoning, Second Revision Brown County Ordinances, to rezone the following described property from its present zoning designation of Chapter 4.06 (AG-P) Agricultural Preservation District to Chapter 4.07 (M-AG) Mini-Agricultural District: Lot 1, B & W Hinrichs Addition in the N ½ NE ¼ of Sec 10-T125N-R60W of the 5th P.M., Brown County, SD. (40989 119th Street).  Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Kippley-aye, Fjeldheim-aye.  Motion carried.

FAIR SPECIAL EVENT: Moved by Sutton, seconded by Kippley to approve concept of Special Event to be held at the 2018 Brown County Fair, proposed by Fair Manager Derek Ricci and John Hoffman, representing the Ramkota; on condition that all proper licenses and permits are obtained.  All members present voting aye.  Motion carried.

COMMISSION ASSISTANT REPORT: Gary Vetter presented the survey of the building to be purchased, as requested during July 10, 2018 meeting. 

EXECUTIVE SESSION: Moved by Hansen, seconded by Sutton to go into executive session to consult with legal counsel, per SDCL 1-25-2(3) with Chris White and Gary Vetter in attendance; and further discuss personnel, per SDCL 1-25-1with Chris White, Gary Vetter and Patti Marshall in attendance.  All members present voting aye.  Motion carried.  The Chair declared the executive session closed, with no action taken as a result of the discussion.  

ADJOURNMENT:  Moved by Kippley, seconded by Fischbach to adjourn the Brown County Commission at 10:15 a.m.  All members present voting aye.  Motion carried.
