JUNE 5, 2018 – GENERAL MEETING
Meeting called to order by Commission Chair Fjeldheim at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen, Sutton, Fischbach and Kippley. Commissioner Fischbach led the Pledge of Allegiance.
MINUTES: Moved by Sutton, seconded by Hansen to approve the General Meeting Minutes of May 29, 2018. All members present voting aye. Motion carried.

HR REPORT: Moved by Kippley, seconded by Fischbach to approve the following Commission Assistant/HR Office Report, which includes the following personnel changes:
Acknowledge retirement of Sandy Green, Treasurer Deputy, effective June 15, 2018; and further approve request to fill vacancy.
Approve Sheila Enderson, Treasurer, to re-advertise for part-time deputy position that has not been filled.
Approve hiring Mitchell Aman as part-time JDC Correctional Officer, effective June 5, 2018 @ $13.69 per hour.
Approve transfer of Lacey Lopez-Martinez from part-time JDC Correctional Officer to full-time Jail Correctional Officer, effective June 21, 2018 @ $16.15 per hour; and further approve request to fill vacancy for part-time JDC Correctional Officer.
Acknowledge Dearborn National renewal rates for July 1, 2018 thru July 1, 2019.
All members present voting aye. Motion carried.
SURPLUS SALE RECAP: Moved by Sutton, seconded by Hansen to approve all surplus proceeds to be distributed back to department funds. Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Fjeldheim-aye, Kippley-nay. Motion carried.
STRIPING AGREEMENT: Moved by Fischbach, seconded by Sutton to approve and authorize the Chair sign agreement with the SD DOT for the striping of approximately 66.0 miles of county roads within Brown County at estimated cost of $71,161.20 (County share @ $55,279.75, State share @ $15,881.45). All members present voting aye. Motion carried.
APPLICATIONS FOR OCCUPANCY: Moved by Kippley, seconded by Hansen to approve and authorize the Chair sign the following applications submitted by Northwestern Energy for occupancy of Brown County Hwy #10 (387th Ave) in Sec 11–T121N-R64W and Sec 14-T121N-R64W to provide electrical service. All members present voting aye. Motion carried.
SPEED ZONE AMENDMENT: Commissioner Sutton offered the following Resolution: RESOLUTION #30-18. WHEREAS, Chapter 6.03 Speed Zones of the Second Revision of Brown County Ordinances authorizes the Brown County Commission to change the speed limit or the extent of any such limited speed zones, at any time they may deem necessary, and WHEREAS, all Speed Zones throughout the County were established by Resolution #46-05, as amended by Resolution #66-06, Resolution #39-08, Resolution #72-08, Resolution #101-08, Resolution #94-13, Resolution #69-14, Resolution #15-16, and Resolution #26-17, and WHEREAS, the Brown County Commission has received the recommendation from the Highway Superintendent to amend the speed zone on County Road 14 to accommodate a turning lane for the Soybean Plant. NOW THEREFORE BE IT RESOLVED that Resolution #46-05, as amended by Resolution #66-06, #39-08, #72-08, #101-08, and #94-13, #69-14 and #15-16 and #26-17, be amended as follows: AMEND: County Road #14 (391st Avenue), beginning at the intersection of County Road #14 and US 12 between the SW ¼ of Section 15, Township 123N, Range 63 W of the 5th PM and the SE ¼ of Section 16, Township 123N, Range 63W of the 5th PM, then North on County Road #14 (391st Ave) one mile, at 45 MPH. Seconded by Commissioner Fischbach. Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Fjeldheim-aye, Kippley-aye. Resolution adopted.
BROWN COUNTY HWY 13: Moved by Kippley, seconded by Hansen to approve and authorize the Chair to sign the Brown County Hwy 13 Asphalt Concrete Surfacing Agreements. All members present voting aye. Motion carried.
FAIR CONTRACT: Moved by Fischbach, seconded by Kippley to approve and authorize the Chair to sign the following contract for the 2018 Brown County Fair: Midcontinent Communications for media advertisement services. All members present voting aye. Motion carried.
ORD - SET HEARING DATE: Moved by Hansen seconded by Sutton to set public hearing for consideration of application, submitted by Steve Bogenhagen for Ordinance #476, An Ordinance to amend Title 4 – Zoning, Second Revision Brown County Ordinances, to rezone the following described property from its present zoning designation of Chapter 4.06 (AG-P) Agricultural Preservation District to Chapter 4.07 (M-AG) Mini-Agricultural District: Lt 1 Bogenhagen Subdivision in the SE ¼ of Sec 4-T122N-R63W of the 5th P.M., Brown County, SD (13671 391st Avenue) to be held in the Brown County Commission Chambers, Courthouse Annex at 8:45 a.m. on July 3, 2018. All members present voting aye. Motion carried.
ORD 477 - SET HEARING DATE: Moved by Kippley seconded by Fischbach to set public hearing for consideration of application, submitted by H&H Farms for Ordinance #477, An Ordinance to amend Title 4 – Zoning, Second Revision Brown County Ordinances, to rezone the following described property from its present zoning designation of Chapter 4.06 (AG-P) Agricultural Preservation District to Chapter 4.07 (M-AG) Mini-Agricultural District: LT 1, J & J Hedges Subdivision in the SE ¼ of Sec 21-T123N-R64W of the 5th P.M., Brown County, SD (1750 385th Ave South) to be held in the Brown County Commission Chambers, Courthouse Annex at 8:45 a.m. on July 3, 2018. All members present voting aye. Motion carried
SPECIAL EVENT LIQUOR LICENSE APPLICATION: Moved by Sutton, seconded by Kippley to authorize advertising public hearing for the following Special Liquor License Application: Stacy Gossman DBA Big Fella’s for event at Stutsman Harley Davidson, 717 385th Ave S., Aberdeen, SD – Lot 1 Browning 1st Addition, NW ¼ of Sec 22-T123N-R64W, 5th P.M. (Lot 1 Great Plains Ag Addition and Winters Outlot), Brown County, SD at 8:50 a.m. on June 19, 2018 (Special License effective June 23, 2018). All members present voting aye. Motion carried.
DONATION: Moved by Sutton, seconded by Fischbach to acknowledge donation to the Brown County Dive Team received from Midco Foundation for $1,000. All members present voting aye. Motion carried.
LEASE AGREEMENT: Moved by Hansen, seconded by Kippley to approve and authorize the Chair sign the following agreement: Keirsta Zerbil for lease of the Richmond Lake Youth Camp Lodge on September 8-9, 2018 with permission to serve alcoholic beverages. All members present voting aye. Motion carried.
AG LAND ASSESSMENT: Carson Storm met to discuss the Ag land assessment update. No action was taken at this time.
EXECUTIVE SESSION: Moved by Sutton, seconded by Kippley to go into executive session for legal counsel, per SDCL 1-25-2(3) with Chris White, Gary Vetter and Gene Loeschke in attendance; and further discuss personnel, per SDCL 1-25-2(1) with Chris White and Gary Vetter in attendance. All members present voting aye. Motion carried. The Chair declared the executive session closed, with no action taken as a result of the discussion.
