JANUARY 23, 2018 – GENERAL MEETING
Meeting called to order by Commission Chair Fjeldheim at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen, Sutton, Fischbach and Kippley. Commissioner Hansen led the Pledge of Allegiance.
MINUTES: Moved by Sutton, seconded by Hansen to approve the Joint City County Meeting Minutes and the General Meeting Minutes of January 16, 2018. All members present voting aye. Motion carried.

HR REPORT: Moved by Hansen, seconded by Sutton to approve the following Commission Assistant/HR Office Report, which includes the following personnel changes:
Acknowledge resignation of Erin Doering, HR Assistant, effective February 2, 2018; and further approve request to fill vacancy.
Approve request to fill vacancy for Landfill Equipment Operator Grade 4.
Approve military leave of absence for Mike Hill, Deputy Sheriff effective February 12, 2018 thru June 26, 2018.
Approve the following Employee Step Increases, effective January 28, 2018: Ben Smith @ $23.91 per hour, Kari Steiner @ $15.41 per hour.

LEASE AGREEMENT: Moved by Fischbach, seconded by Kippley to approve and authorize the Chair sign the following agreement: Liebelts RV for lease of the Holum Expo Building on Mar 5-18. All members present voting aye. Motion carried.
RLYC HOUSE LEASE: Moved by Fischbach, seconded by Hansen to approve and authorize the Chair sign agreement with Darren Ghost and Michona Edge for lease of the County owned house at 37909 Youth Camp Road, effective February 1, 2018 at $800.00 per month. All members present voting aye. Motion carried.
LANDFILL MONITORING CONTRACT: Moved by Sutton, seconded by Fischbach to approve and authorize the Chair sign 2018 agreement with Leggette, Brashears and Graham, Inc. for all monitoring and general environmental/hydrogeologic consulting at the Brown County Landfill at an estimated cost of $69,640.00. All members present voting aye. Motion carried.
PLATS: Commissioner Kippley offered the following Resolution: Resolution #04-18. BE IT RESOLVED by the Board of County Commissioners of Brown County, SD, that the plat showing “Jones Conservation Easement in the NW ¼ of Sec 34-T124N-R65W of the 5th P.M., Brown County, SD”, having been examined, is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof. Seconded by Commissioner Hansen. Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Fjeldheim-aye, Kippley-aye. Resolution adopted. Commissioner Sutton offered the following Resolution: Resolution #05-18. BE IT RESOLVED by the Board of County Commissioners of Brown County, SD, that the plat showing “Fischbach Conservation Easement Tracts in the W ½ of Sec 13-T122N-R64W except road, of the 5th P.M., Brown County, SD”, having been examined, is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof. Seconded by Commissioner Hansen. Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-abstain, Fjeldheim-aye, Kippley-aye. Resolution adopted.
GRANT AWARD AGREEMENT CELL 3: Moved by Hansen, seconded by Sutton to approve and authorize Chairman to sign South Dakota Solid Waste Management Program Grant Award #2018G-SW-400 for Brown County Landfill Cell #3 Construction Project in amount of $490,000 (total project cost @ $2,474,350); and further authorize Chairman to sign payment requests. All members present voting aye. Motion carried.
WIND ENERGY PROJECT: Acknowledge letter of notification for the proposed Day County II Wind Project that would interconnect with Western Area Power Administration’s (WAPA) Groton South 115-kV Substation.
ESRI AGREEMENT: Moved by Kippley, seconded by Hansen to approve and authorize the Chairman to sign the Esri Small Public Safety Enterprise License Agreement (ELA) for a term of three years at $15,000.00 per year (split 50/50 between GIS and Dispatch). All members present voting aye. Motion carried.
POLICY MANUAL AMENDMENT: Moved by Sutton, seconded by Hansen to amend Policy I – Purchasing Policy and Replacement Procedures, as follows:
Policy Overviews
Goods and services valued from $0 to $5,000 do not require a formal quote or bid.
Goods and services valued from $5,001 and $15,000 request two formal quotes.
All other provisions of policy are unchanged and in full force and effect. All members present voting aye. Motion carried.
ORD 114- SET HEARING DATE: Moved by Sutton, seconded by Hansen to set public hearing for consideration of Ordinance #114, An Ordinance to amend Title 4 – Zoning, Second Revision Brown County Ordinances, to rezone the following described property from its present zoning designation of Chapter 4.06 (AG-P) Agricultural Preservation District to Chapter 4.07 (M-AG) Mini-Agricultural District: Ball Pioneer Farm Outlot A in the SE ¼ of Sec 7-T121N-R60W of the 5th P.M., Brown County, SD (14399 407th Ave), to be held in the Brown County Commission Chambers, Courthouse Annex at 8:45 a.m. on February 13, 2018. All members present voting aye. Motion carried.
ORD 113: Moved by Sutton, seconded by Kippley to adopt Ordinance #113, An Ordinance to amend Title 4 – Zoning, Second Revision Brown County Ordinances, submitted by Ryan Dell on behalf of Debra Cleveland to rezone the following described property from its present zoning designation of Chapter 4.06 (AG-P) Agricultural Preservation District to Chapter 4.07 (M-AG) Mini-Agricultural District: Lots 1 & 2 Cleveland First Addition in the NE ¼ of Sec 35-T124N-R63W of the 5th P.M., Brown County, SD (39279 129th Street). Roll call vote: Commissioners Hansen-aye, Sutton-aye, Fischbach-aye, Fjeldheim-aye, Kippley-aye. Ordinance adopted.
BCCHC REPORT: DeAnna Harber presented the Brown County Community Health Center Report for October-December 2017.
PORTABLE TRAFFIC CONTROL UNITS: Robin Bobzien, Aberdeen City Public Works Director, met to discuss the possibility of the county and city cost sharing the purchase of portable traffic signal units; and further explore grant funding that may be available. Board concurred. Derek Ricci, Fair Manager was also in attendance.
EXECUTIVE SESSION: Moved by Sutton, seconded by Hansen to go into executive session to consult with attorney, per SDCL 1-25-2(3) and to discuss personnel, per SDCL 1-25-2(1) with Chris White and Gary Vetter in attendance. All members present voting aye. Motion carried. The Chair declared the executive session closed, with no action taken as a result of the discussion.
