Vacate Roadway
RESOLUTION AND ORDER VACATING ROADWAY
Petitioners Rick and Carla Pahl of Claremont Township, Brown County, South Dakota, presented the following resolution and order and moved for its adoption:
Whereas, a petition having been received asking that Claremont Township vacate a roadway described as Dinsmores 1st Addition, Lots 1-6 on the NE and Lots 19-24 on the NW 1/4 Section 02-T125-R60W.
That the existing public right-of-way which includes the statutory right-of-way and any right-of-way acquired by deed(s) lying as follows:
Running north and south commonly known as Dinsmore 1st Addition. Bordered by Lots 1-6 on the NE and Lots 19-24 on the NW 1/4 Section. Located in Section 02-T125-R60W, Township Claremont, Range 60, Brown County, South Dakota. That said public right of way being approximately 30 feet wide and 300 feet in length.
And further said Petition being in proper form and executed by more than the required number of electors of Claremont Town and further it having been determined that a vacation of said roadway will better serve the public convenience; and that further this Petition having come on at a special meeting of the board; and no one appearing in opposition thereto (or in the alternative objection being heard); and said Supervisors having considered said matter and being fully advised in the premises and considering it advisable to do so:
NOW, THEREFORE, BE IT RESOLVED, AND IT IS HEREBY ORDERED:
That the existing public right-of-way which includes the statutory right-of-way and any right-of-way acquired by deed(s) lying as follows:
Running north and south commonly known as Dinsmore 1st Addition. Bordered by Lots 1-6 on the NE and Lots 19-24 on the NW 1/4 Section. Located in Section 02-T125-R60W, Township Claremont, Range 60, Brown County, South Dakota. That said public right of way being approximately 30 feet wide and 300 feet in length.
It is further ordered that said Resolution shall be published in the official/legal newspaper of the respective township once per week for two consecutive weeks; and that after such publication, such roadway shall be, after a lapse of thirty days after the last publication thereof, vacated without further proceedings unless appealed as provided by law; and that the Clerk herein is further ordered and directed to cause to be recorded a true and correct copy of this Resolution and Order in the office of the Register of Deeds in and for Brown County, South Dakota.
It is further ordered that any and all bridges, guard rails and culverts are hereby deemed to revert to (not) and become personal property and possession of Claremont Township.
The motion was made by Supervisor Jason Spencer and was seconded by Supervisor Frank Rasmussen and upon roll call, the vote was as follows:
Supervisors: Chairman Shane Johnson yes; Jason Spencer yes; Frank Rasmussen yes.

I, Charla Rye, being the duly elected, qualified and acting clerk of the Board of Supervisors of Claremont Township, Brown County, South Dakota, do hereby certify that the foregoing is a true and correct copy of the Resolution on the action thereon by the Board of Supervisors of Claremont Township, Brown County, South Dakota, at the regular meeting of said Board, held the 12th day of December, 2017, as the same appears and is now recorded in the minutes of the Clerk of the Board of said Claremont Township and that the same is true and correct transcript thereof.
